Birthing Injury Compensation Claims

Pregnancy and childbirth should be exciting and special and marked by happy memories.

However, in the unfortunate event of medical negligence during the pregnancy, labour or during the delivery which results in a birth trauma or injury, families can be left physically, emotionally and financially devastated.

What is birthing trauma compensation?

Birthing trauma compensation provides compensation to mothers who are injured (physically and/or psychologically) due to negligence during childbirth. It holds the medical practitioner or hospital team involved accountable for their negligence.

It also allows the families of infants born with injuries due to medical negligence to understand the events of the birth of their infant and to recover compensation to cope with the medical expenses involved in raising an injured child, as well as the ongoing costs and losses throughout the child’s life. It provides compensation to the child for the inability of that child to live the life he or she otherwise could have.

Compensation

Claims generally includes compensation for:

  1. General damages for emotional distress, and pain and suffering;
  2. Medical expenses, including medications, consultations, and other treatments associated with the immediate and future management of the injury;
  3. Therapy and other rehabilitation (eg occupational therapy, speech therapy etc);
  4. Counselling and psychological immediately and into the future;
  5. Home adaptations, aids and equipment; and
  6. The loss of entitlement to work in a chosen profession or at all.
